What is a court filing fee?

Court filing fees in Montana cost $1 to $2,500. The table below has the fees set in 2016.  


How do I ask the court to waive the filing fees?

If you can't afford to pay the fee you can ask the judge to allow you to file your paperwork without having to pay the fee. You ask the judge for permission to file your forms without paying a fee by filing a "fee waiver" form. 

After you complete the fee waiver form, you must give the fee waiver to the court clerk where your court case is being handled. The official name for the fee waiver form is a "Statement of Inability to Pay Court Costs and Fees." Here you can download a Statement of Inability to Pay Court Costs and Fees that you can give to the court clerk to ask the judge to let you file court paperwork without paying a fee.

After you file the fee waiver form, the judge will review it to decide whether you have to pay the fee. It may take the judge a day or two to make that decision. The court clerk may not let you file your court form until after the judge makes a decision about your fee waiver. So, if there is a deadline for the court document you are filing, be sure to file your fee waiver form at least one day before the deadline for filing your court documents.
