Before You Complete the Forms

These forms should be accepted in any disctrict court in Montana but please note that some district courts may have their own forms. Contact your local Clerk of Court or Self Help Law Center if you are unsure if the court will accept these forms. If you are leaving an abusive relationship or have questions about your rights, you should talk to an attorney. If you cannot afford an attorney, you can apply for free legal help from Montana Legal Services Association.

Form completion time: 45 to 90 minutes

You will be able to stop and save your work in the middle of the program.

What you need before starting the forms:

  1. You must read the Introduction to Family Law in Montana before starting this program.
  2. If you have children from your marriage, you must have a child support calculation or order in effect before using this program. When completing the program, you should have your child support case number available. You can complete a child support calculation to submit to the court using the Montana Online Child Support Calculator.
  3. Before you get started, you can complete a worksheet to gather all of the information the program will ask you when completing the forms. Download the Questions to Answer Before You Go Online.
  4. You will need a laptop or desktop computer to complete this program because it will not work on a smartphone or tablet. Find your nearest library.

Make sure this program is right for you:

You cannot use this program if:

  1. Your spouse has already filed a Petition for a Divorce. If your spouse has filed a Petition for Divorce, you should file an Answer to the Petition.
  2. You have filed a divorce petition in any other state or county;
  3. You plan to ask your spouse for alimony or other financial support (other than child support);
  4. You or your spouse own real estate outside of Montana;
  5. You or your spouse have a pension, retirement account, or 401(k);
  6. You or your spouse is pregnant;
  7. Either you or your spouse do not have physical custody of one or more of your children;
  8. Either you or your spouse have not lived in Montana for at least 90 days;

Information you will need when completing the program:

  1. You and your spouse's name, address and birthdate;
  2. Your marriage date, location, and where it was registered;
  3. Your separation date;
  4. A complete list of personal property owned by you and/or your spouse, and its value;
  5. A complete list or real property (land and/or home) owned by you and/or your spouse including its estimated value;
  6. A complete list of all bank accounts, retirement accounts, stocks, bonds, etc. owned by you and/or your spouse, including estimated value;
  7. A list of all businesses held by you and/or your spouse, including estimate value;
  8. A list of any other assets (boats, mobile homes, etc.) owned by you and/or your spouse, including estimated value;
  9. A complete list of all debts owed by you or your spouse, including creditor name and amount owed;
  10. A list of monthly expenses; and
  11. A. list of monthly income.

If you need help:

  1. You can visit your local Self Help Law Center. These centers can answer basic questions but cannot give legal advice. Find a center near you.
  2. You can apply online for free legal help from Montana Legal Services Association.
  3. You can contact the Montana Bar Lawyer Referral and Information Service to find a lawyer near you.

Now that you are ready to complete the program:

  1. It is a good idea to save your answers when completing the program in case you need to return at another time.
  2. In order to save your answers, you must create a username and password.
