Do I Have To Pay Our Credit Card If My Ex-spouse Did Not Make The Payments?
by: Montana Legal Services Association (MLSA)   LSC LOGO
Q.

Question:

Do I have to pay our credit card if my ex-spouse did not make the payments?

A.

Answer:

Yes. If a credit card account is in your name, then you will need to make the payments. This will protect your credit. If you have a joint credit card account with your ex-spouse, both of you are responsible for paying the credit card debt. This is true even if a judge has signed divorce papers saying your ex-spouse is responsible for the debt. The credit card company can keep seeking payments from you. If you are thinking about divorce, you may want to talk to credit card companies about your accounts and options.  For links to information and resources for credit and credit reports, click here.  For links to forms, information and resources relating to consumer law as a whole, click on this.

You may lose important legal rights if you do not hire an attorney immediately to advise you. Many people do not check their e-mail daily, and some attorneys do not respond to unsolicited e-mail from non-clients.
